On January 23, 2019, Medina Hajdarevic,
Second Secretary of the Australian Embassy Economic Section, and Li Lianqing, Official
of Advanced Research and Project, paid a second visit to CRCFDI. Professor Lu
Jinyong, Director of CRCFDI, and Dr. Li Xiaoyong, Research Secretary of the
Center, received them in the office, and had a discussion with them. In recent
years, China's policies and regulations on the utilization of foreign investment
have been greatly revised and improved. Especially on December 26, 2018, the
Standing Committee of the National People's Congress promulgated the “Foreign
Investment Law (Draft)” to solicit social opinions, which has aroused
widespread concern at home and abroad. The main purpose of their visit is to
consult some issues related to the “Foreign Investment Law (Draft)”. During the
discussion, Director Lu Jinyong discussed with them and answered the following
questions they came up with: the reason why the Chinese government speeded up
the formulation of the “Foreign Investment Law” since last year, the reason why
the length of the “Foreign Investment Law” is relatively short, the
relationship between the “Foreign Investment Law” and other specific foreign
investment policies and regulations, the impact of the Sino-US trade war on the
formulation of the “Foreign Investment Law”, the relationship between the “Foreign
Investment Law” and the “Negative List of Foreign Investment Access (2018
Edition)” as well as the “Negative List of Market Access (2018 Edition)”, how
to understand the provision of Article 22 of the “Foreign Investment Law
(Draft)” on "No mandatory technology transfer by administrative means",
how to understand the provision of Article 33 on "Establishing foreign investment
security censorship", the impact of Australian Foreign Investment Review Board
(FIRB) on China's direct investment in Australia.
